Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website at glowglass.media (the "Site") and any services, enquiries, or previews requested through the Site ("Services"), operated by Glow Glass Media, a trading name of LANTHEON PTY LTD (ABN 28 695 758 868, ACN 695 758 868) ("we", "us", "our"), a company registered in Queensland, Australia.
By accessing or using the Site, or by submitting an enquiry or preview request, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site for lawful purposes only. You must not:
- Use the Site in any way that violates any applicable Australian federal, state (including Queensland), or local law or regulation;
- Transmit any unsolicited commercial communications;
- Attempt to gain unauthorised access to any part of the Site or its related systems;
- Submit false or misleading information;
- Reproduce, distribute, or commercially exploit any content from the Site without our prior written consent; or
- Use any automated tools to scrape, crawl, or extract data from the Site.
2. Free window preview
We offer a free window preview service that uses photographs of your shopfront to produce an illustrative mock-up of what Glow Glass could look like on your window. By submitting a preview request you confirm that:
- You have the right to submit the photograph (for example, because you own or occupy the premises, or have obtained any required consent);
- You consent to us using your submitted photograph for the purpose of preparing your preview; and
- You understand that the preview is illustrative only — actual results will depend on your window size, glass type, installation conditions, and other factors assessed during the formal suitability review.
A free window preview does not constitute a quote, binding offer, or agreement to supply. No contractual obligation arises until a formal written agreement has been entered into between you and Glow Glass Media.
3. Enquiries and information
Information provided on the Site — including pricing indications, earnings estimates, technical specifications, and suitability guidance — is provided for general information purposes only and is subject to change without notice. Pricing and suitability can only be confirmed following a formal assessment of your specific premises and requirements.
Indicative earnings information for the Glow Glass Earn product is illustrative only. Revenue is not guaranteed and will vary based on location, audience, screen time, advertiser demand, and network approval.
4. Intellectual property
All content on the Site — including text, graphics, logos, images, video, and software — is owned by or licensed to LANTHEON PTY LTD and is protected by Australian copyright law and applicable international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except as permitted by law (including fair dealing for personal use under the Copyright Act 1968 (Cth)).
Nothing in these Terms transfers any intellectual property rights to you.
5. User-submitted content
By submitting photographs or other content through the Site, you grant us a non-exclusive, royalty-free licence to use that content for the purpose of providing the Services you have requested. We will not use your submitted content for any other purpose (including promotional materials) without your express written consent.
You warrant that any content you submit does not infringe the intellectual property rights of any third party and does not contain any unlawful material.
6. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Site, you consent to the collection and use of your personal information as described in the Privacy Policy.
7. Disclaimer of warranties
The Site and its content are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied. To the maximum extent permitted by law (including the Australian Consumer Law), we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.
Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.
8. Limitation of liability
To the maximum extent permitted by law, LANTHEON PTY LTD and its directors, employees, and agents will not be liable for any loss or damage (including indirect, incidental, special, consequential, or punitive damages, or loss of revenue, profit, data, or goodwill) arising from or in connection with your use of the Site or Services, even if we have been advised of the possibility of such loss or damage.
Where our liability cannot be excluded by law, our total liability to you in connection with the Site or Services is limited to the amount paid by you (if any) for the specific service giving rise to the claim, or AUD $100, whichever is greater.
9. Third-party links and services
The Site may contain links to third-party websites or services (including booking tools). We have no control over, and accept no responsibility for, the content or practices of those third parties. The inclusion of any link does not imply endorsement by us.
10. Availability and changes to the Site
We reserve the right to modify, suspend, or discontinue the Site or any part of it at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Site.
11. Governing law and jurisdiction
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for the resolution of any dispute arising in connection with these Terms.
12. Consumer guarantees (Australian Consumer Law)
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel the service and receive a refund for the unused portion, or to compensation for its reduced value. You are also entitled to compensation for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time, and, if this is not done, to cancel and obtain a refund for the unused portion of the service.
13. Changes to these Terms
We may update these Terms from time to time. The updated Terms will be posted on the Site with a revised "last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.
